These terms and conditions ("Terms") govern your use of the XpertBot Academy Mobile App ("the App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the App.
The App is designed to test XpertBot Academy students and determine their eligibility to progress from Phase 1 to Phase 2. The App utilizes facial recognition technology to detect and prevent cheating during the exam process.
a. Eligibility: By using the App, you represent that you are a registered student of XpertBot Academy and have obtained the necessary permissions to use the App for testing purposes.
b. Compliance: You agree to comply with all applicable laws and regulations while using the App. You understand that any misuse or unauthorized use of the App is strictly prohibited.
c. User Conduct: You agree to use the App solely for its intended purpose and refrain from engaging in any activity that may compromise the integrity of the testing process, including cheating, impersonation, or fraudulent behavior.
a. Personal Information: The App may collect personal information, including but not limited to your name, photograph, and test results. By using the App, you consent to the collection, storage, and processing of your personal information for the purposes outlined in these Terms and in accordance with the App's Privacy Policy.
b. Facial Recognition: The App uses facial recognition technology to detect cheating during exams. Your photograph will be captured during the test, and the App will analyze it to identify any suspicious behavior.
Data Storage Duration: The face data captured during exams will be securely stored for a period of 24h, which is determined by our security and operational needs. After this period, the face data will be automatically deleted from our servers.
We are committed to safeguarding your data and ensuring that it is not stored indefinitely, in accordance with best practices and privacy regulations.
a. Ownership: The App and all its content, including but not limited to text, graphics, images, logos, and software, are the property of XpertBot Academy and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.
b. Restrictions: You may not modify, reproduce, distribute, sell, lease, sublicense, or create derivative works based on the App or its content without the express written consent of XpertBot Academy.
a. Accuracy: While the App strives to provide accurate and reliable testing, XpertBot Academy makes no warranties or representations regarding the accuracy, reliability, or completeness of the test results obtained through the App.
b. Cheating Detection: The App's cheating detection measures are designed to identify suspicious behavior but may not guarantee 100% accuracy. XpertBot Academy shall not be held responsible for any false positives or negatives detected by the App.
c. Use at Own Risk: The use of the App is at your own risk. XpertBot Academy and its affiliates shall not be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages arising from the use or inability to use the App.
XpertBot Academy reserves the right to modify, suspend, or terminate the App or these Terms at any time, with or without notice. You agree that XpertBot Academy shall not be liable to you or any third party for any modifications, suspension, or termination of the App or these Terms.
These Terms shall be governed by and construed in accordance with the laws of state of California. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in San Francisco County.
